The recent ruling in favor of the Plaintiffs in the Sierra Club et al. v. Scott Pruitt case has left the TSCA certification date unknown. In this case, the Sierra Club was challenging EPA’s authority to extend the compliance date to December 2018. The judgement in favor of the Sierra Club resulted in the vacating of the TSCA Title VI compliance extension date. The judge however temporarily stayed the order to allow the Parties (EPA and Sierra Club) to negotiate an alternative compliance date. This means that the compliance date will likely be moved to a date earlier than December 2018. The Parties have until March 9, 2018 at 4 pm to meet and confer on an alternative compliance date, and then submit either a joint proposed submission or simultaneous briefs. It is possible that the Department of Justice (DOJ) could decide to appeal this case, although this is not considered the likely outcome.
While we are confident that reasonableness prevails in this case, we are announcing that all Arauco North America mills will immediately be moving to full TSCA certification. This certification and associated labeling will take place between March 15 and March 30, 2018.
The move to TSCA certification is not an emission issue for our operations. Arauco North America has been operating at TSCA equivalent emission levels and has been running our QC data set as if we were under the TSCA environment to prepare for this eventuality. The time between now and the full certification dates provided above will allow us to finish building out our “test before ship” methodology and permit us to complete the installation of upgraded data collection and analysis tools that will further support our ongoing history of excellence on regulatory compliance. Our goal is to ensure our customers continue to have the highest levels of trust regarding emission levels from our products in our new TSCA environment.
